The department said today that Tarry Bratton, president and owner of Chanceford Township-based B.C. Inc. and trustee of the company’s retirement plan, has resolved the complaint filed in April by restoring nearly $150,000 to the plan.
The complaint alleged that Bratton and the company knowingly violated the Employee Retirement Income Security Act, also known as ERISA, and “failed to make efforts to collect the contributions beginning in January 2009.”
The amount was initially alleged to have been closer to $250,000. However, the company provided third-party proof that some payments were made, so adjustments were made for those payments, a labor department spokeswoman said.
Bratton was not immediately available for comment on the lawsuit’s dismissal.
