In brief: New direct-care protections don't apply here


Nearly two million direct-care workers — home health aides, personal care aides and certified nursing assistants — will receive minimum wage and overtime protections starting in 2015 under a new rule from the U.S. Department of Labor.

Pennsylvanians will not be among them, however, according to attorney Thomas Collins with Buchanan Ingersoll & Rooney, because they already have those protections.

The state has been enforcing them since about 2009, when a legal challenge of the domestic services exemption to the state minimum wage act caused Pennsylvania to implement the same standards that the DOL is now mandating nationwide.
